Brakto, operated by Filantus LLC ("Company," "we," "our," or "us"), respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), codified at 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using our Service that are reported to our Designated Copyright Agent.

If you are a copyright owner, or authorized to act on behalf of one, and believe that copyrighted work has been infringed on or through our Service, please submit a notice in accordance with the requirements below.

3. Filing a DMCA Takedown Notice

To file a notice of copyright infringement, you must provide a written communication to our Designated Agent that includes substantially the following (pursuant to 17 U.S.C. § 512(c)(3)):

1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
2. Identification of the infringing material: A description of the material that you claim is infringing and its location on our Service, with enough detail to allow us to locate the material. Please provide the URL(s) where the infringing content appears.
3. Your contact information: Your name, mailing address, telephone number, and email address.
4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy and authority statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

4. Counter-Notification Process

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our Designated Agent. Your counter-notification must include (pursuant to 17 U.S.C. § 512(g)(3)):

1. Identification of the removed material: A description of the material that has been removed or disabled and the location where it appeared before it was removed.
2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original takedown notification or their agent.
4. Your contact information: Your name, address, and telephone number.
5. Signature: Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action against you within 10 business days of receiving the counter-notification, we will restore the removed material within 10 to 14 business days after receipt of the counter-notification, at our discretion.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Brakto has adopted and reasonably implemented a policy that provides for the termination, in appropriate circumstances, of users who are repeat infringers. Specifically:

• First offense: The infringing material will be removed and the user will receive a written warning via email.
• Second offense: The infringing material will be removed, the user will receive a second warning, and their upload privileges may be restricted.
• Third offense: The user's account will be terminated. Content associated with the terminated account may be permanently removed.

We reserve the right to terminate any account at any time for egregious or willful infringement, regardless of the number of prior offenses.

6. Content Removal Procedure

Upon receipt of a valid DMCA takedown notice, we will:

1. Promptly remove or disable access to the allegedly infringing material.
2. Notify the user who uploaded the material that it has been removed.
3. Provide the user with a copy of the takedown notice and information about how to file a counter-notification.

Content types that may be subject to DMCA takedown requests on our platform include:

• Tournament logos and branding images
• Tournament flyers and promotional materials
• Competitor and team photos (including voting contest entries)
• Club logos and organization branding
• Any other user-uploaded images or content

7. Limitation of Liability

Brakto acts as an online service provider under 17 U.S.C. § 512. We do not monitor, screen, or edit user-uploaded content before it is posted. We are not liable for copyright infringement by our users, provided that we comply with the DMCA's notice-and-takedown procedures as described in this policy.

8. Modifications to This Policy

We reserve the right to modify this DMCA Copyright Policy at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated policy.
